Time 4 agreements:-
Time for agreements are great for both parties, but please be aware of what the term means.
The Halfling Project:-
In return for working on the halfling project you receive in digital form images from the shoot, selected video and audio work without charge.
This applies subject to the following agreement:-
That you agree use and continued use of images within the halfling project work and respect that William David is the copyright owner to all work.
Subject to this agreement being maintained you have full rights to use the images provided or a/v work for your own self promotion or non commercial use with the set watermarking.
You may request non watermarked images for print reproduction etc although there may be a charge for this.
One confusion can occur when actors / performer 's are joining an agency who wish sole rights to all images and related material produced prior to signing as well as future work and that this right covers world distribution.
Advice should be taken from an independent source before entering such an agreement, few agents expect such agreement, but live in hope!!
It should be clear that only William David can agree to limitation of image use or that images may be used for third party commercial gain without written consent of William David and where appropriate payment.
As part of the original terms of a time for halfling project shoot - the project maintains the full rights to use images within William David work without further consultation. Those taking part are given upon image receipt the chance to request certain images are not used - but after 14 days the images [except those agreed to remain confidential] can be used within William David work, and as editorial may also be included may then only be retracted under extreme circumstances.
Should any participant of a time for halfling shoot wish all images not in future to be used then this become's a break of contract between themselves & William David. In the event of an agreement to remove images is accepted the following may apply:-
That no images A/V may be used by the participant in future without payment.
That a contract breakage fee will apply as the request would breech the original time for status of the work.
When considering making a image retraction request [often on advice of a third party] please be sure it is in your best interests and not that of a third party.
